Standard Website Package Elements
The standard website package contains the following elements:
- Webpage design and construction of pre-determined number of HTML pages, including text and graphics
- Optimization of images for web publication
- Transmission of web design to client's server
- A CD of files will be kept in Rabbitfoot Design Studio archives
Additional Fees
Additional fees shall be billed for the following services:
- The addition of e-commerce ability to site
- The addition of form scripts (such as guestbook, contact form, etc.)
- The addition of HTML pages beyond the agreed-upon number
- The addition of Flash animations or pages
- The addition of other database-driven elements
- Search engine optimization
Core Site Elements
Rabbitfoot Design Studio staff will work closely with the client to establish core site elements such as menu navigation and site design. CSS files, tables, or databases may be used to this end. Once these core site elements are established, revisions may not be made. The client assumes full responsibility for layout, design, and navigation choices from that point forward. At the discretion of Rabbitfoot Design Studio staff, minor adjustments may be made without the client accruing additional costs. However, a revision of core site elements will require a Change Request Form and may be subject to additional charges.
Maintenance and Pay Rate
This agreement between the client and Rabbitfoot Design Studio will be for the duration of 45 days. Revisions and additions to the site after 45 days shall be done at Rabbitfoot Design Studio's current maintenance rate, plus any additional fees as apply.
Web Hosting and Domain Name Registration
The client understands that all web hosting service will be purchased through Rabbitfoot Design Studio for a period of at least one (1) year, and with a one-time activation and set-up fee of $30 for 1 domain name. The client agrees to allow Rabbitfoot Design Studio staff full access to the website and a cgi-bin directory via FTP for all websites they are contracted to develop or maintain.
Legal Stuff
Rabbitfoot Design Studio does not warrant that the functions contained in these webpages or the Internet website will meet the client's requirements on all browsers or that the operation of the webpages will be uninterrupted or error-free. The entire risk as to the quality and performance of the webpages and website is with client. In no event will Rabbitfoot Design Studio be liable to the client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate these webpages or website, even if staff has been advised of the possibility of such damages.
Copyrights and Trademarks
The client represents to Rabbitfoot Design Studio staff and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to them for inclusion in client's website are owned by the client, or that the client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend Rabbitfoot Design Studio and staff from any claim or suit arising from the use of such elements furnished by the client.
Laws Affecting Electronic Commerce
From time to time governments enact laws and levy taxes and tariffs affecting Internet electronic commerce. The client agrees that the client is solely responsible for complying with such laws, taxes, and tariffs, and will hold harmless, protect, and defend Rabbitfoot Design Studio and staff from any claim, suit, penalty, tax, or tariff arising from the client's exercise of Internet electronic commerce.
Copyright to Webpages
Copyright to the finished, assembled work of webpages produced by Rabbitfoot Design Studio is owned by Rabbitfoot Design Studio unless other agreements are made in writing.
Upon final payment of this contract, the client is assigned use rights to the design, graphics, and text contained in the finished assembled website. Rights to photos, graphics, source code, work-up files, and computer programs are specifically not transferred to the client, and remain the property of their respective owners. Rabbitfoot Design Studio staff retain the right to display graphics and other Web design elements as examples of their work in advertisements and portfolios.
